JOHN BAD ELK V. UNITED STATES, 177 U. S. 529 :: Volume 177 :: 1900 :: Full Text :: US Supreme Court Cases from Justia & Oyez
This cop should be shot. Under John Bad Elk v. United States, this cop is a trespasser and assaulted this guy. Under the "castle doctrine" this guy had every right to shoot the cop for violating his rights and assaulting him. The cop had no authority to continue to harass and threaten. Once he started doing that, he lost all authority as a public official and committed Official Misconduct--a felony crime in every state--that would have cost him his job.
